Accused Rapist Had Sex With Victim ‘To Save Her Life’

Utah man Rodger William Kelly is accused of first-degree felony rape in what he says was actually a valiant life-saving rescue attempt. Authorities have not confirmed whether or not his actions saved the victim; his arrest this week suggests otherwise.

Rodger Kelley, 50, of St. George, Utah, found a female neighbor unconscious on her front porch on May 19, 2013. So Kelley did what any Good Samaritan would have done, he claims: He took her into his apartment because she was cold from being outside; he laid her on his bed and changed her into his clothes. He then lay down next to her to warm her.

When EMTs arrived in response to the unconscious-person 911 call, they found Kelley giving the woman CPR in his apartment. Later, she told authorities that she thought she had been raped, and had the pelvic and upper-thigh bruising to prove it. It was too late to do a rape kit by then. The woman said that at one time she had been in a relationship with Kelley, said that she had broken it off and told Kelley that the sex was also over.

When police came back and interviewed Kelley about the events of May 19, he reportedly added a tiny detail: that while the unconscious woman was on the bed, he inserted his penis into her vagina to warm her, because according court documents, “he was trying to save her life.” The probable cause statement filed by police describes his rationale in more detail, “He said he did place it inside of her to try and get her temperature up.”

Investigators alerted him to the fact that that was the same as rape, and on June 9 charged him with a single count of felony rape.
