A 46-year-old police captain turned himself in to Broward County, Fla., authorities Friday following accusations of lewd or lascivious conduct on a child under 16. Back in January, Miramar Police Captain Juan De Los Rios was in uniform when he allegedly approached a parked car where a 15-year-old girl and a teenage boy were sitting in the back seat. De Los Rios allegedly asked them if they were having sex, and when they said they weren’t, he ordered the girl to get undressed so that he could inspect her. ”Well, are you having sex? What are you doing here?,” De Los Rios allegedly asked. ”No, no, no, Officer. No,” the victim replied.
At this point, according to the arrest affidavit (seen below,) De Los Rios told the girl he needed to “see inside” and made her take off her underwear and spread her legs before examining her genitalia with a flashlight. De Los Rios allegedly asked, “No anal sex? No sex in general?” after looking at the victim’s vagina. He also allegedly made her pull down her shirt, telling her he needed to check her breasts for bruising. According to what the victim told police, De Los Rios never touched her.
The victim told police she complied with the orders because De Los Rios was in uniform and appeared to be a police officer. She later told her sister and mother, who called authorities. The victim later identified De Los Rios as her assailant in a double-blind photo array. De Los Rios is charged with lewd or lascivious conduct on a child younger than 16. He is free on bail and is currently on unpaid leave. The Miramar Police Department told press, “an administrative investigation is presently being conducted, which precludes the department from speaking further on the matter.” De Los Rios has made no comments regarding the accusations against him.
